Acceptable Use Policy

1. About this policy
This Acceptable Use Policy ("AUP") applies to everyone who accesses or uses the Hook platform ("Hook", the "Service"), including the website, product, AI assistant, scriptwriter, and any associated apps or integrations, provided by Markt AI Ltd, a company registered in England and Wales (company no. 16133663), registered office 128 City Road, London EC1V 2NX ("Markt AI", "Hook", "we", "us"). Markt AI Ltd is a subsidiary of Hook AI, Inc. (Delaware, USA).
This AUP forms part of, and should be read alongside, our Terms of Service. If there is a conflict between this AUP and the Terms of Service, the Terms of Service prevail unless this AUP is more specific to the conduct in question, in which case this AUP applies to that conduct.
By using Hook you agree to comply with this AUP. We may update it from time to time; the current version always applies.
2. Purpose
Hook collects publicly available content from social platforms using data-collection providers, analyses it using AI / machine-learning providers, and produces competitive benchmarks, creative blueprints, video-level analysis, an AI assistant, and related tools. This AUP exists to keep that activity lawful, respectful of the individuals and platforms whose content is analysed, and safe for all users.
3. Prohibited uses
You must not use Hook, or allow Hook to be used, to do any of the following.
3.1 Unlawful activity
- Use Hook in any way that breaches applicable law or regulation in any jurisdiction relevant to you or to the individuals or businesses whose content or data you access through Hook.
- Use Hook to facilitate, plan, or conceal any unlawful, fraudulent, or deceptive activity.
3.2 Harassment, contact, and misuse of individuals' data
- Use Hook, or any output, insight, analysis, or data obtained from Hook, to harass, stalk, threaten, intimidate, defame, or otherwise harm any individual.
- Use Hook to identify, locate, or contact an individual creator or other person without a lawful basis for doing so, including where the purpose is unsolicited direct marketing, recruitment, or personal contact unrelated to the individual's public professional or public-facing activity.
- Attempt to re-identify, de-anonymise, or combine Hook data with other sources to build a profile of an individual beyond what is necessary for the legitimate competitive and creative-intelligence purposes Hook is provided for.
- Use any special-category data (for example data revealing health, sexual orientation, or religious or political belief) that may incidentally appear in publicly analysed content to target, profile, or make decisions about any individual. Hook does not intentionally collect this data and does not permit customers to use it for these purposes.
- Use Hook in any way that targets, profiles, or attempts to identify individuals under the age of 18.
3.3 Interfering with or reverse-engineering Hook
- Scrape, crawl, harvest, or extract data from Hook itself (as opposed to the third-party social platforms Hook analyses) by automated means, except through features and APIs we expressly provide for that purpose.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying models, architecture, or sub-processors of Hook.
- Attempt to bypass, disable, or circumvent any rate limit, access control, authentication mechanism, or usage restriction we apply.
- Probe, scan, or test the vulnerability of Hook or any related system or network, or breach any security or authentication measure, except where expressly authorised by us in writing.
- Introduce any virus, malware, or other harmful code, or engage in denial-of-service or similar disruptive activity against Hook.
3.4 Resale and redistribution
- Resell, sublicense, rent, lease, or otherwise commercially redistribute access to Hook or its outputs to any third party, except where your plan or a written agreement with us expressly permits this.
- Systematically republish, syndicate, or bulk-export Hook's analyses, benchmarks, blueprints, or underlying data in a way that recreates a competing product or dataset.
- Represent Hook's outputs as your own independent research or data collection in a way that is misleading to a third party.
3.5 Excessive or abusive automated access
- Use bots, scripts, or other automated means to access Hook in a manner that places unreasonable load on our infrastructure, degrades the Service for other users, or is disproportionate to normal use of your plan.
- Create multiple accounts, or use another person's account, to circumvent Free-plan usage limits or suspension.
3.6 Source-platform terms and third-party rights
- Use Hook in a way that you know, or ought reasonably to know, requires us or you to breach the terms of service, intellectual property rights, or community guidelines of the social platforms from which content is collected (including Instagram, TikTok, YouTube, LinkedIn, X, and Facebook).
- Infringe the intellectual property, publicity, or other rights of any creator, brand, or platform in content accessed through Hook.
Hook collects publicly available content through third-party data-collection providers on a legitimate-interests basis. There is no official creator opt-in or platform partnership implied by your use of Hook, and you remain responsible for using outputs in a way that respects third-party rights.
3.7 Platform integrity and misuse of AI features
- Use Hook's AI assistant, scriptwriter, or chat features to generate content that is unlawful, defamatory, harassing, or that impersonates a real person without disclosure.
- Attempt to extract another customer's workspace data, uploaded files, or knowledge base through prompt injection, shared-account access, or any other unauthorised means.
- Use Hook to generate spam, or content intended to deceive audiences into believing it is independently created by a person or entity when it is not.
4. Your responsibility for your account and workspace
You are responsible for all activity that occurs under your account, including content your team uploads to the workspace knowledge base and how your team uses Hook's outputs. If you operate a business account with multiple users, you must ensure those users are aware of and comply with this AUP.
5. Monitoring
We do not routinely monitor the content of customer workspaces, uploads, or chat interactions, but we may review usage patterns, logs, and reported conduct to investigate suspected breaches of this AUP, protect the security and integrity of Hook, or comply with a legal obligation.
6. Consequences of breach
If we reasonably believe you have breached this AUP, we may, at our discretion and depending on severity:
- issue a warning and require corrective action within a set period;
- restrict, throttle, or suspend some or all of your access to Hook;
- remove or disable access to specific content, integrations, or features;
- terminate your account and Terms of Service with us, including without refund for the remainder of the current billing period, in line with our Terms of Service;
- report the conduct to relevant authorities, affected platforms, or affected individuals where we consider this appropriate or legally required.
Where reasonably practicable, we will notify you before taking action and give you an opportunity to respond, except where we reasonably believe immediate action is necessary to prevent harm, protect Hook or other users, or comply with law. Suspension or termination under this AUP does not limit any other right or remedy available to us under the Terms of Service or at law.
7. Reporting a violation or a removal request
If you believe someone is misusing Hook in breach of this AUP, or you are an individual whose publicly available content has been analysed by Hook and you wish to object to that or request removal, contact contact@askhook.com.
Not every removal request is handled the same way. If you are an individual asserting a statutory right to object to or erase your data, that request is assessed under the objection and erasure process described in our Privacy Policy, which sets out how we balance your request against our legitimate interests and any legal obligations. If you are requesting removal, please use the subject line "Removal Request" so it can be routed appropriately. We aim to acknowledge removal requests promptly and to action valid requests without undue delay.
If you are reporting suspected abuse of Hook by another user, please include as much detail as possible (account, content, dates, and nature of the concern) so we can investigate.
8. Relationship to other policies
This AUP should be read together with our Terms of Service, Privacy Policy, and, where applicable, our data processing terms. See also our Cookie Policy, Refund Policy, and Sub-processors page. Definitions used but not defined in this AUP have the meaning given in the Terms of Service.
9. Governing law
This AUP is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from it.
